Terms and Conditions of BN CLUB

Welcome to BN Club (the "App"), owned and operated by Elzhana BN ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

1. Health and Wellness Disclaimer (Not Medical Advice)

THE APP PROVIDES GENERAL WELLNESS, LIFESTYLE, RECIPE, AND FITNESS INFORMATION FOR EDUCATIONAL PURPOSES ONLY. IT IS NOT INTENDED AS MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

  • Always consult a physician or qualified healthcare provider before starting any new diet, nutrition plan, or exercise routine, especially if you have pre-existing health conditions, injuries, or food allergies.
  • Never disregard professional medical advice or delay seeking it because of information accessed through the App.
  • Your participation in any workout, recipe preparation, or nutritional program presented in the App is purely voluntary and performed at your own risk.

2. User Accounts

  • You must be at least 17 years old to create an account.
  • You agree to provide accurate, complete information when creating an account and to keep your credentials secure.
  • You are responsible for all activities that occur under your account. Notify us immediately if you suspect unauthorized access.

3. Subscriptions, Billing, and Cancellations

BN Club offers recurring auto-renewable subscription plans providing access to premium content, recipes, and workout programs.

  • Payment Processing: All purchases and subscription billings are processed directly through the Apple App Store (for iOS users) or the Google Play Store (for Android users). We do not store or process your financial billing details.
  • Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (e.g., monthly or annually) unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Pricing: Pricing is clearly displayed within the App prior to purchase and may vary by region or currency as determined by app store platforms.
  • Cancellation Process: You may cancel your subscription at any time through your device settings:
  • iOS: Go to your device Settings > Apple ID > Subscriptions > BN Club > Cancel Subscription.
  • Android: Go to Google Play Store > Profile Icon > Payments & Subscriptions > Subscriptions > BN Club > Cancel Subscription.
  • Refunds: Refund requests must be submitted directly to Apple or Google in accordance with their respective refund policies. We cannot issue direct refunds for app store purchases.

4. Intellectual Property

All recipes, workout programs, audio/video content, graphic assets, trademarks, and software within the App are the exclusive intellectual property of Elzhana BN and protected by copyright and intellectual property laws. You are granted a limited, personal, non-exclusive, non-transferable license to access and use the App for non-commercial purposes. You may not copy, distribute, modify, or resell any content without prior written permission.

5. Prohibited Conduct

You agree not to:

  • Reverse-engineer, decompile, or attempt to extract source code from the App.
  • Bypass authentication, security controls, or subscription entitlements.
  • Use the App to distribute unauthorized commercial promotions, spam, or malicious code.
  • Share or redistribute subscription-only workout or nutrition materials outside the App.

6. Termination and Account Deletion

We reserve the right to suspend or terminate your account if you violate these Terms. You may terminate your account at any time using the in-app Delete Account feature located in your Profile settings. Termination of your account terminates your access to the service; recurring billing must still be cancelled through your app store settings.

7. Limitation of Liability

To the maximum extent permitted by law, Elzhana BN and BN Club shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including personal injury, physical discomfort, allergic reactions, loss of data, or loss of profits arising out of or related to your use of the App.

8. Governing Law

These Terms are governed by and construed in accordance with the applicable laws of the jurisdiction in which Elzhana BN operates, without regard to its conflict of law principles.
